The Florida Department of Transportation (FDOT) issued a press release on December 27, 2022, regarding its accomplishments in 2022 and the outlook for 2023.

Jared Perdue, the FDOT Secretary said, “Florida has a diverse transportation system, so it’s important that we continue to balance the needs of our communities with safety and environmental considerations, while also providing an advanced and resilient transportation infrastructure. From safe mobility options for Floridians and visitors, to facilitating an effective supply chain, a reliable and robust transportation system truly impacts all of us on a daily basis.”

2023 FL Transportation Work Zone SafetyAccording to the press release, FDOT has several projects nearing completion in 2023, including the I-4 and SR-557 projects in Southwest Florida, which FDOT believes will significantly improve safety. Another project is the completion of the widening of SR-388 in Northwest Florida to improve access to the Northwest Florida Beaches International Airport. Southwest Florida has a phased I-95 project to manage express lanes, continuing projects in the restoration of Pine Island and Sanibel Island in Southwest Florida, and many others.

An FDOT study found that there is an average of over 13,000 work zone accidents involving nearly 100 deaths in Florida every year. The hazards involved in work zones can cause very complex personal injury cases when considering liability.

Most Common Types of Work Zone Accidents

  • Rear-end accidents
  • Sideswipes
  • Pedestrian accidents
  • Barriers and cone accidents
  • Colliding with work zone equipment

Work Zone Accident Liability

Several entities could be considered liable in a work zone accident, including another driver for being distracted and/or negligently driving and not following directions when in a work zone, a construction company for not having adequate warning signs, and construction equipment manufacturers for malfunctioning equipment.

Florida also has a right-of-way law under Title XXIII, Chapter 316 State Uniform Traffic Control, Section 316.076 “Duty to yield to highway construction workers” that can complicate a personal injury lawsuit.
