Blown Tire Accidents Cause Tragic Deaths and Injuries

March 24, 2022 | Category: Tire Failures | Share

In December 2021, two North Fort Myers women tragically died after a blown tire caused an accident on I-75 in Broward County. Three other people in the SUV were seriously injured, according to the Florida Highway Patrol (FHP).  The SUV’s left tire blew out, and the driver lost control. Their SUV ran off the freeway and into a canal.

When blown tire accidents cause tragic deaths & injuriesFort Myers Tire Failure Lawyer Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A. said, “Over the years tread separation, blown tires, and tire recalls have made the news. Many accident victims are seriously injured or even die because of defective tires. Manufacturers and installers may be liable for defective tires or the incompetent installation of the tires. Sometimes, vehicle owners may be responsible for blown tire accidents if they fail to maintain their vehicles. When they cause an accident with another vehicle, they may be held responsible for their inaction.”

Even with properly maintained vehicles, tires may experience blowouts causing devastating injuries to the drivers, passengers, other motorists, pedestrians, and/or bicyclists. These accidents need to be investigated to determine what contributed to the tire failure which may include but are not limited to negligent repair and/or maintenance, poor road maintenance, and road debris created by other motorists.

The National Highway Traffic Safety Administration (NHTSA) reports that 612 people tragically died in tire-related accidents in 2019 (the latest available statistics). The NHTSA shares the following information about tire blow-outs:

Negligence in repair and/or maintenance

Most automotive repair people are skilled, but they can improperly install or rotate tires which can lead to blowouts. When tires explode because of the actions of a mechanic who may either improperly install the tires, over-inflate, or under-inflate the tires, or do not notify the vehicle owner of any damage to the tire(s), they may be negligent.

Poor road maintenance

If a driver cannot reasonably avoid road conditions that may be hazardous, the city or state that was responsible for maintenance may share the responsibility for the accident.

Road debris from other vehicles

If a vehicle encounters dangerous objects that have fallen from other vehicles, the driver of the other vehicle may share the blame for your tire blowout. Commercial and private vehicles are responsible for securing their loads so as not to cause hazards.
