$3 Million Jury Award for Former Immokalee Middle School Teacher Upheld

 

On March 15, 2013 the $3 Million jury award in the David Bowdler suit against State Farm Insurance Company was upheld by the District Court of Appeal of Florida, Second District.  Attorney Randall Spivey, Spivey Law Firm, Personal Injury Attorneys, P.A. represented Mr. Bowdler in the four-day jury trial which resulted in the original verdict in April, 2011.  

David Bowdler  was the victim of a Fort Myers car accident in 2008, two days after Christmas, as he was travelling westbound on 12th Street West in Lehigh Acres.  He was struck at Douglas Avenue by a vehicle which ran a stop sign.  Attorney Spivey's client was taken to Lee Memorial Hospital with a cervical facet fracture and broken left wrist. 

David Bowdler had been at Immokalee Middle School for 35 years, most recently as a science teacher.  He  was taking some time off, and was looking forward to returning to class at the end of the one-year leave when the accident occurred.  This will never happen. 

The driver who struck Mr. Bowdler's pickup truck was underinsured, and Mr. Bowdler's insurance company, State Farm, refused to pay him the limits of the coverage he purchased which included a $2 million underinsured motorist policy. They only paid him $190,000.
