$5 Million Lee County, Florida Motorcycle Accident Settlement

Motorcycle Accident

A 48 year old concrete mason was riding his motorcycle on Bonita Beach Road when the Defendant pulled from a stop sign into his path striking him. According to the Florida Department of Highway Safety and Motor Vehicles and the National Highway Traffic Safety Administration, failure to yield the right of way to a motorcycle is the most common cause of serious and fatal motorcycle accidents.

The motorcyclist received a pelvic fracture, coccyx fracture, right tibia/fibula fracture resulting in a below the knee leg amputation, left femur fracture, heterotopic bone growths in joints, left radius and ulnar fracture, and proximal right humerus fracture which resulted in many months in the hospital.

Randall Spivey, Spivey Law Firm, Personal Injury Attorneys, P.A., the motorcyclist's attorney, commented, "The Defendant's insurance policy limits were $100,000.  Defendant's insurance carrier did not properly accept a demand made by us.  As a result, we pursued a bad faith case."  Mr. Spivey successfully obtained a $5 million settlement for the motorcycle accident victim shortly before the trial was to begin.

“Just because a person carries insurance and pays the premiums, does not mean the insurance company will pay the claim.  If they do pay the claim, the amount they pay may be well under what should be paid due to the type and severity of accident, the personal injury, present and future medical expenses and pain and suffering. It's important not to “sign away” rights to the insurance company. See an attorney.”
