Accidents Caused by Poor Lighting in Parking Lots

August 5, 2020 | Category: Slip and Fall Accidents | Share

Inadequate lighting can cause different types of accidents, including slip and fall accidents and vehicle accidents. Pedestrians who encounter drivers who are steering around a dark corner in a narrow parking lot may be hit due to the driver’s poor vision. Poor lighting can also cause vehicle crashes if the road users cannot see surrounding obstacles at night.

Accidents Caused by Poor Lighting in Parking LotsDark or inadequate lighting in parking lots is the responsibility of property owners. They are required to keep their property safe from hazards that could cause injuries. This includes lighting. If the lighting is not sufficient, a person may not see any changes in elevation and could walk into danger. Stairways and other fall-prone areas need to be illuminated at all times.

Electrical failures may cause parking lot lighting to go dark. To prevent this, owners should have generators or battery-powered lighting available as backup prevention.

If a person suffers injuries because of poor lighting conditions, he/she may have a claim against the property owner or person in control of the property who allowed an unsafe condition to exist.

Florida Statute 768.0755 says businesses are liable for injuries if it is proven they had constructive knowledge of dangerous conditions that caused an injury. Property owners are required to use reasonable care to keep their businesses free of potential hazards. If they fail to do so or fail to warn users of potentially dangerous conditions, they can be liable for injuries caused by negligence on the property.

A personal injury attorney can gather and present evidence regarding dangerous conditions, the length of time the conditions existed, that owners should have known about the conditions and that the conditions occurred regularly and were foreseeable.

An injured person may recover medical expenses; past, current, and future lost wages; pain and suffering, and certain other statutory or common law damages.
