Senate Bill (SB) 382 Establishes New E-Bike Safety Rules in South Florida

The Florida Senate unanimously passed SB 382 on March 17, 2026. The bill is now awaiting Governor DeSantis’ signature; once signed, it will take effect immediately.

SB 382 establishes two new safety requirements related to e-bikes. The key provisions of the bill include:

• Yielding to Pedestrians – Under SB 382, e-bike riders will be required to yield to pedestrians and “give an audible signal before overtaking and passing a pedestrian” when riding on shared pathways in parks and other recreational areas.
• 10 mph Speed Limit in Pedestrian Areas – When riding on sidewalks or in areas “designated for pedestrian use,” e-bike riders may not go more than 10 miles per hour if they are within 50 feet of a pedestrian.

Violating either of these requirements constitutes a non-criminal traffic infraction. While previous versions of the bill included licensing requirements and other additional rules and restrictions for e-bikes, these are not included in the bill’s final version. However, the final version does retain a requirement for the Florida Highway Patrol (FHP) to maintain a list of all traffic accidents involving e-bikes, with this list to be used to prepare reports submitted to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV), the Governor’s office, and the state legislature.

1. Be Mindful of the Speed of E-bikes

 Electric bikes generally travel much faster than traditional bikes.  E-bikes can travel up to 20 – 28 mph. Motorists need to keep this in mind because e-bikes will quickly approach an intersection or crosswalk.

When making a left-hand turn at an intersection, always remember that an approaching e-bike will reach the intersection quickly before turning at the intersection in front of an approaching e-bike.

2.  Maintain a Safe Distance

Motorists are required by law to maintain a minimum of 3 feet of horizontal clearance when passing a bicyclist or e-bike. Motorists need to keep a safe distance when changing lanes and make sure that there is clear space and enough distance to pass and change lanes.

3.  Check Before Turning

Before turning right or turning on red, motorists should check to their right and behind their vehicle for e-bikes and bicyclists. They should yield to anyone in the bike lane, turn behind them, and never cut them off.

4.  Scan for Bikes When Opening Car Doors

Motorists should always check side mirrors and physically look back for approaching cyclists to prevent opening a car door into the street and hitting a bicyclist. E-bike accidents occur when a parked driver or passenger opens a vehicle door into the path of an oncoming rider, causing a severe impact or forced swerve. 5.  Stop Completely at Driveways and Parking Lots
