Hurt By Drunk Driver - 5-car crashEarly Sunday morning, January 13, 2013 there were 5 crashes at mile marker 126 on I-75 (between Alico and Corkscrew Roads)  in south Fort Myers, FL.  Six vehicles were involved in the 5 crashes; several people were sent to the hospital; two are in critical condition. Two drivers in separate vehicles involved in the crashes were arrested for DUI. The southbound lanes of I-75 were shut down for seven hours.

That same evening, January 13, 2013, six children and one adult were injured in Cape Coral, Florida after the minivan they were in went off the road into a ditch.  Three of the children suffered life-threatening injuries.  The Cape Coral, Florida Policy Department reports the crash was DUI related.

"Drunk driving must be stopped, and we must do everything we can to assist those who have been injured through no fault of their own." said Fort Myers DUI Injury Attorney, Randall Spivey, Spivey Law Firm, Personal Injury Attorneys, P.A.  "Our firm has dedicated its legal practice to using all available Florida laws to obtain fair and just compensation and has a website, Hurtbydrunkdriver.com specifically to assist victims of drunk drivers.  These victims may be injured as the result of car accidents, motorcycle accidents, truck accidents, pedestrian accidents, boating accidents, or ATV accidents."

Victims are protected by drunk driving laws.  These laws cover Punitive Damages, Federal Bankruptcy Law, Criminal Action and Civil Action.

Punitive Damages - Punitive damages punish the drunk or impaired driver for his or her illegal, negligent and reckless behavior.

Federal Bankruptcy Law - When a lawsuit results in a monetary judgment against a person who causes a drunk driving accident resulting in injuries or death, he or she cannot discharge that debt by filing for bankruptcy relief.

Criminal Charges - The State of Florida permits a victim of a drunk driving accident to request a restitution order through the criminal proceedings, ordering the impaired driver to reimburse the victim for costs related to the injuries he or she sustained.

Civil Action - Victims have further recourse under Florida law.  Our DUI accident attorneys can bring civil cases against drunk drivers responsible for causing accidents, including personal injury lawsuits or wrongful death actions.
