Motorcyclist's Wrongful Death Settlement

November 13, 2019 | Category: Motorcycle Accidents, Wrongful Death | Share

The family of a motorcyclist who crashed into a turning armored truck reached a settlement for wrongful death with the security company which owned the truck. The settlement of $100 million occurred as a state court jury began deliberations.

Motorcyclist's Wrongful Death Settlement - Spivey LawPolice reports say the male motorcyclist was riding alongside, and slightly behind, the armored truck that suddenly attempted to make a left turn from the far right lane. The motorcyclist died at the scene after slamming into the side of the truck. Surveillance video discovered after the accident prompted the motorcyclist’s wife to file a wrongful death lawsuit for negligent homicide against the armored truck driver.

“Motorcycle accidents are very common in Southwest Florida, and they can easily lead to the death of the motorcyclist or passenger,” said Fort Myers Motorcycle Accident Attorney Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A.

The Insurance Institute for Highway Safety (IIHS) says 5,172 motorcyclists died in crashes in 2017. They accounted for 14 percent of all motor vehicle crash deaths, more than double the number of motorcyclist deaths in 1997.

Florida’s Wrongful Death Act provides specific consideration for those who have lost loved ones due to the negligence of another. They may be entitled to monetary damages for mental pain and suffering, loss of earnings, loss of support and services, and loss of contributions to the household.

Those who may be held liable include:

  • Vehicle owner, if not the driver
  • Driver’s employer
  • Bars or anyone who served the negligent driver alcoholic beverages if alcohol is determined to be the cause of the accident

“I have spent years representing families who have lost family members because of another person’s negligence.
