Should A Visitor From Another Country Hire A U.S. Attorney When Hurt By A Drunk Driver?

March 7, 2014 | Category: Automobile Accidents | Share

Every 90 seconds someone is injured in a drunk driving crash, according the National Highway Traffic Safety Administration (NHTSA).  Too many people, including foreign visitors, are harmed each year in the U.S. as the result of drinking and driving.

Should a visitor from another country hire a U.S. attorney when hurt by a drunk driver - Spivey Law Firm, Personal Injury Attorneys, P.A.Drunk driving crash victims may not only be affected physically, but also emotionally and financially.  In fact, the financial impact can be significant and over-whelming - costs of medical care, travel, phone bills, counseling, and lost wages to name a few. There is no guarantee that the medical bills of the injured person will be covered by the drunk driver's vehicle insurance policy, or, that the injured will be justly compensated.

In a personal injury claim, the use of alcohol can be considered an aggravating circumstance.  Hurt By A Drunk Driver Attorney, Randall Spivey, advises clients as to the actual value of a case and acts on their behalf to insure they are not taken advantage of by low insurance company offers.  Clients may be entitled to damages for the harm they have suffered and for punitive or exemplary damages.

Multiple parties may be liable for damages.  For example, should a drunk driver be served too much at a bar, restaurant, club or a private party, those serving the drunk driver may be liable, along with the establishment in which the drunk driver was served.

Foreign visitors need to hire a U.S. personal injury attorney in the state in which the vehicle accident occurred.  These are the advantages:

  1. The personal injury laws vary by state. Every state has its own statute of limitations law which covers the amount a time a potential victim has to file a claim.  Also, the determination of what is considered "legally drunk" varies by state.
  2. To receive fair compensation, it is necessary that the attorney have knowledge of personal injury laws.  Insurance companies may be eager to settle quickly which may not be in the best interest of the injured party, and many insurance companies automatically offer lower settlement amounts to victims without attorneys.
  3. A dispute may occur over who was at fault in the vehicle accident.  To establish fault in this type of accident case, many depositions may have to be taken.
  4. Remember, there may also be actions against third parties. Third-party cases may be very fact-intensive.
