Spring Break 2014 And DUIs

Fort Myers Beach is experiencing the busiest Spring Break deputies have seen in years, according to NBC-2 .  In 2013 there were 18 arrests for underage drinking during the Spring Break season, and with this season not even half over, there have already been 8 arrests.

MADD (Mothers Against Drunk Driving) reports that, on average, every 53 minutes someone is killed in a drunk driving crash (9,878 in 2013).  Every 90 seconds, someone is injured. 

Here are some guidelines for remaining safe from DUI this Spring Break season:

  • Underage is underage.  In Florida no one under the age of 21 is allowed to purchase, consume or possess alcoholic beverages.
  • Plan ahead.  Always appoint a "designated driver" before drinking begins.
  • Designated driver - Know your responsibility is important to the safety of your friends and others on the road.
  • Be a "responsible" friend - If you know someone has been drinking and intends to drive, be, or find, a non-drinking designated driver.  Take away the keys. These actions could save your friend's and other's lives.

Spring Break 2014 and DUIs - Spivey Law Firm, Personal Injury Attorneys, P.A.Drivers who are suspected of being under the influence of alcohol or drugs are required by 'implied consent laws' to agree to breath, blood or urine testing. When drivers sign forms when applying for a driver's license, they agree to comply with law enforcement officers' requests to take chemical testing to determine BAC (blood-alcohol content).

Penalties for refusing can mean a suspension of the driver's license for up to one year.  The Florida Department of Motor Vehicles will suspend a driver's license for a DUI conviction.  The first conviction in Florida carries a mandatory suspension of the driver's license for six months. The second and third offense carries mandatory suspensions of one year and two years.
