Three Men Tragically Die From COVID-19 in Long-Term Care Facility

April 3, 2020 | Category: Nursing Home Neglect/Abuse | Share

COVID-19 is spreading rapidly across the United States. Camellia at Deerwood, a long-term care facility in Jacksonville, has had three COVID-19 fatalities.

The Centers for Medicare and Medicaid Services (CMS) investigates assisted living facilities and nursing homes across the United States. The agency looks for deficiencies and non-compliance with its rules covering which facilities will be approved for Medicare and Medicaid patients and reimbursements.

In its investigation of one facility in Washington State, CMS wrote in a report, “The facility failed to have a system in place that ensured timely action related to an identified respiratory outbreak within the facility. There was no evidence the facility recognized all possible systemic risks and concerns related to this known outbreak.”

The News Service of Florida reported on Wednesday, April 1 that federal health inspectors arrived in Florida to evaluate how long-term care facilities are responding to the spread of COVID-19. CMS surveyors “have been on site in a handful of counties where they are in full PPE,” Florida Agency for Health Care Administration Secretary Mary Mayhew said, referring to personal protective equipment.

“This is entirely a federal survey team,” Ms. Mayhew continued. “They are there to evaluate, very quickly, infection prevention and control. They also are intended to be a supportive resource.”

“All Florida nursing homes and assisted living facilities have a legal responsibility to keep their residents safe and follow the law. Should they fail to do so, residents and their families have the right to file personal injury lawsuits. They are entitled to receive monetary compensation for medical expenses, pain and suffering and/or punitive damages,” said Fort Myers Nursing Home Abuse Attorney Randall Spivey of Spivey Law Firm, Personal Injury Attorneys, P.A.
